Why should you have an EAR if you are a seller to the EU?

European authorized representative refers to a natural person or legal person explicitly designated by manufacturers located outside the European Economic Area EEA (including EU and EFTA). The natural person or legal person can perform specific duties required by relevant EU directives and laws on behalf of manufacturers outside EEA

According to the legal requirements of the EU, in order to achieve product traceability, the products with CE mark put into the EU market by the manufacturer must be marked with the manufacturer's name and contact address. If the manufacturer is from a country other than EEA (including EU and eeta), the name and contact address of the manufacturer and the manufacturer’s EU authorized representative must be marked on the label (nameplate or package).

In order to ensure that the EU competent authority can timely inspect the technical documents (TCF) of the products affixed with CE mark, non EU manufacturers shall keep the latest version of the technical documents in the EU authorized representative office for 10 years after the export of the last batch of products.

In case of any failure / accident / recall of products of manufacturers outside the EU in the EU, the authorized representative of the EU shall contact and notify, and the competent authority shall wake up and communicate.

In order to ensure the safety of products sold in the EU market and ensure that products with CE mark imported from outside the EU meet the requirements of EU laws and regulations on consumer, property and environmental protection.

What impact will it have without the European representative?

After July 2021, we learned that it would be illegal for sellers to sell CE marked products without EAR information!

That is to say, the sales threshold of non EU sellers in the European market has become higher! After that, when you sell things in Europe, CE certification alone is not enough. You must also have an European representative, and the European representative must be a European native, a local enterprise, proficient in local safety regulations, and assist you or communicate with European customs, taxation and quality inspection institutions on your behalf.At present, all sellers selling products with CE certification in the EU are required to comply with these changes.

If the seller fails to comply with relevant laws and regulations and the product lacks European representative information, it may be severely punished by the platform, including the removal of the corresponding product link;FBA warehouse inventory was detained. Amazon and European countries will also take coercive measures to prohibit or restrict the sale of these products in the market.
